When you create an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized access to or use of your account. Scouting4U will not be liable for any loss or damage arising from your failure to protect your account credentials.

You may not share, transfer, or sell your account access to any third party. Each subscription is for individual use only unless explicitly stated otherwise in a team or organization plan.

Parental/Guardian Consent Requirements

For athlete profiles featuring individuals under 18 years of age, the following requirements apply:

• A parent or legal guardian must provide verifiable consent before any data or media is uploaded
• The parent/guardian must be the account holder and maintain control over the profile
• Parents/guardians may request removal of their child's data at any time
• Direct messaging features with minor athletes are restricted and monitored

Legal Compliance

We comply with applicable child protection laws including:

• COPPA (USA): Children's Online Privacy Protection Act for users under 13
• Israel Legal Capacity Law: Parental consent required for individuals under 18
• EU/UK GDPR: Parental consent required for individuals under 16

Child Safety Measures

We implement additional safeguards for minor athlete profiles:

• Contact information is never publicly displayed for minors
• All communications must go through the parent/guardian account holder
• Suspicious contact attempts are flagged and investigated
• Priority response for removal requests involving minors

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable local, national, or international law or regulation
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks
• Use any automated means (bots, scrapers, etc.) to access the Service or collect data without our express written permission
• Reproduce, redistribute, sell, or commercially exploit any content or data from the Service without authorization
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Upload or transmit viruses, malware, or any other malicious code

Scouts, recruiters, agents, coaches, and team representatives using our platform must adhere to the following professional standards:

Professional Conduct

• Represent yourself accurately with legitimate professional credentials
• Do not misrepresent your affiliation with teams, leagues, or organizations
• Respect athlete privacy and use data only for legitimate scouting purposes
• Do not contact athletes through unofficial channels or circumvent parent/guardian oversight for minors

Prohibited Activities

Data Usage Restrictions

Athlete data accessed through our platform:

• May only be used for legitimate basketball scouting and recruitment purposes
• Must not be exported, copied, or stored in external databases without authorization
• Must not be shared with unauthorized third parties
• Must be deleted upon termination of your subscription

Enforcement

Violations of these rules may result in immediate account termination without refund, reporting to relevant sports governing bodies, and potential legal action. We reserve the right to investigate complaints and take appropriate measures to protect our users.

Scouting4U allows agents and players to post their or their clients' games on site. Agents or players, who do so, are responsible for the content they post on Scouting4U. By submitting content to our site, you affirm that you own or have acquired all rights to your submission and content.

You must not submit content to our site that is offensive, abusive, libelous or in violation of the laws in your jurisdiction or these Terms and Conditions. Scouting4U reserves the right to reject or remove such content from the Website.

Please note that any information and data described in our web pages may be the subject of other intellectual property rights reserved by Scouting4U and are not licensed hereunder.

Any comments or objection regarding the use of other intellectual rights sent to Scouting4U by the owner of the intellectual right will be removed immediately from the site (scouting4u.com).

Scouting4U shall be free to reproduce, use, disclose, exhibit, display, create derivative works and distribute anything received without restriction or obligation of compensation. Scouting4U shall also be free to use any ideas or concepts provided to maintain its web site.

Scouting4U respects the intellectual property rights of others and expects users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and similar international copyright laws.

Filing a DMCA Takedown Notice

If you believe that content available on our Service infringes your copyright, please submit a written notification containing:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing, with sufficient detail to locate it
• Your contact information (address, telephone, email)
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe your content was wrongfully removed, you may file a counter-notification containing a statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.

Repeat Infringer Policy

We will terminate the accounts of users who are determined to be repeat infringers of copyrights. We reserve the right to take down content and terminate accounts at our sole discretion.

By uploading photos, videos, or other media content to the Service, you grant Scouting4U the following rights:

License Grant

Athlete Likeness Rights

• By creating or authorizing an athlete profile, you consent to the display of the athlete's name, image, and likeness on our platform
• For minor athletes, parent/guardian consent is required for all likeness usage
• Athlete profiles may be viewed by scouts, coaches, agents, and other basketball professionals
• Video highlights and photos may be displayed publicly to showcase athlete abilities

Third-Party Media

You represent and warrant that you have all necessary rights, permissions, and consents to upload any media content, including content featuring third parties. You are solely responsible for obtaining required releases from any individuals appearing in your uploaded content.

Content Removal

You may request removal of your uploaded content at any time by contacting us at gutt@scouting4u.com. We will process removal requests within 30 days, though cached or archived versions may persist for a reasonable period. For minor athletes, parents/guardians may request immediate priority removal.

Nature of Ratings

• All ratings and rankings represent subjective professional opinions, not objective facts
• Ratings may be generated through algorithmic analysis, human evaluation, or a combination of both
• Different evaluators may reach different conclusions about the same athlete
• Ratings are based on available data and may not reflect an athlete's complete abilities

AI & Algorithmic Processing

Some ratings and analytics on our platform utilize artificial intelligence and automated algorithms. While we strive for accuracy, automated systems may contain biases or errors. Users are encouraged to use ratings as one factor among many when making scouting or recruitment decisions.

No Guarantee of Opportunity

Scouting4U does not guarantee that any rating, ranking, or profile will result in recruitment opportunities, scholarship offers, professional contracts, or any specific outcome. The presence of an athlete profile on our platform does not constitute an endorsement of the athlete's abilities or potential.

Rating Disputes

If you believe a rating or assessment is factually inaccurate or unfair, you may submit a dispute to gutt@scouting4u.com. We will review disputes in good faith but reserve final discretion over all ratings and assessments.

The Service may contain videos, statistics, images, and other content from third-party sources including but not limited to basketball leagues, teams, and content providers. Scouting4U does not claim ownership of third-party content and such content remains the property of its respective owners.

We are not responsible for the accuracy, completeness, or legality of third-party content. If you believe any content on our platform infringes your intellectual property rights, please contact us immediately at gutt@scouting4u.com and we will promptly investigate and take appropriate action.

Links to third-party websites are provided for convenience only. Scouting4U is not responsible for the content, privacy policies, or practices of any third-party websites.

Registration is required for the use of our service. Access to certain portions of the site shall be limited for non-paying users.

In order to register to our site, users are requested to give us their contact information (email), demographic information, and additional information as found suitable in our sole discretion. Following the completion of the registration process, you will have to purchase one of our packages.

For users who purchase any of our member packages, the prices of all subscription fees are clearly marked and are inclusive of VAT and duty (where applicable).

Cancellation Policy:

You may cancel your subscription to your member's package at any time by providing us notice by e-mail to gutt@scouting4u.com (the "Termination Notice"). The Termination Notice shall be titled "Subscription Cancellation" and shall include your username, password and ID#.

If you use more than one computer you must always log off on one computer before logging in on another.

Termination by You: You may terminate your account at any time by following the cancellation procedure described in the Registration and Payment section above.

Termination by Us: We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason including but not limited to:

• Breach of these Terms of Use
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• At our sole discretion for any other reason

Effect of Termination: Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You agree to defend, indemnify, and hold harmless Scouting4U, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or upload to the Service

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Scouting4U regarding your use of the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Scouting4U.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure: Scouting4U shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, or internet service failures.

Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.
