Types of Athletic Data

We may collect athletic performance statistics, game footage, physical attributes (height, weight, wingspan), training metrics, injury history (with consent), and performance analytics. This data is essential for our scouting and evaluation services.

Purpose & Legal Basis

Athletic data is processed based on your explicit consent and contractual necessity to provide scouting services. You may withdraw consent at any time, though this may limit our ability to provide certain services.

Special Protections

Athletic and biometric data receives enhanced encryption, restricted access controls, and is never sold to third parties. We conduct regular audits to ensure compliance with Israeli PPL Amendment 13 requirements.

Photos, Videos & Media Content

Media Collection

Our platform hosts photos and videos of athletes including game footage, highlights, and profile images. By uploading media or allowing media of yourself to be uploaded, you grant us a license to display, distribute, and use such content for scouting purposes.

Likeness Rights

You retain ownership of your likeness. However, you grant Scouting4U a non-exclusive, worldwide, royalty-free license to use, reproduce, and display uploaded media in connection with our services, including promotional materials (with separate consent for promotional use).

Third-Party Video Content

Game footage and videos from leagues, teams, and broadcasters remain the property of their respective owners. We display such content for informational and analytical purposes under fair use principles.

Media Removal

You may request removal of media content featuring you by contacting us at gutt@scouting4u.com. We will process removal requests within 30 days, subject to any legal obligations to retain such content.

Minor Athletes & Parental Consent

Age Requirements

Users must be at least 18 years old to create an account. However, athlete profiles may feature individuals under 18 with verifiable parental or guardian consent. Parents/guardians must complete our Parental Consent Form before any minor's data is collected or displayed.

COPPA Compliance (United States)

For users under 13 years of age, we comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without verifiable parental consent. Parents may review, delete, or refuse further collection of their child's data.

Israel Legal Capacity Law

In accordance with Israeli Legal Capacity and Guardianship Law, we require parental consent for processing data of individuals under 18. Consent must be provided by a parent or legal guardian with parental responsibility.

EU/UK GDPR - Children's Data

For users in the EU/UK, we require parental consent for users under 16 (or lower age threshold as specified by member state law, minimum 13). We implement age verification and parental consent mechanisms compliant with GDPR Article 8.

Parental Rights

Applicability

AI & Automated Decision-Making

Use of Algorithms

Our platform uses algorithms and automated systems to analyze athletic performance, generate player rankings, provide recommendations, and match athletes with opportunities. These systems assist scouts and recruiters but do not replace human judgment.

Automated Profiling

We may use automated processing to create athlete profiles including performance scores, strengths/weaknesses analysis, and comparison metrics. This profiling is based on objective statistical data and publicly available information.

Human Oversight

Significant decisions affecting athletes (such as profile visibility, content moderation, or account actions) are reviewed by human personnel. We do not make fully automated decisions with legal or similarly significant effects without human review.

Right to Object

You have the right to object to automated decision-making and profiling, particularly where it produces legal or similarly significant effects. Contact us to request human review of any automated decision.

Algorithm Transparency

Our ranking and recommendation algorithms consider factors including: statistical performance, game footage analysis, physical attributes, competition level, and consistency metrics. We do not discriminate based on protected characteristics.

AI-Generated Content Disclosure

Any content on our platform generated by artificial intelligence is labeled as such. AI-generated analysis or summaries are provided for informational purposes and should be verified by users.

International Data Transfers

Data Location

Our primary servers are located in Israel. We also use cloud infrastructure providers with servers in the United States, European Union, and other regions to ensure optimal performance and reliability.

Transfer Mechanisms

When transferring data outside Israel, we rely on: (a) Adequacy decisions - transfers to countries deemed adequate by Israeli law; (b) Standard Contractual Clauses (SCCs) - EU-approved contractual safeguards; (c) UK International Data Transfer Agreement (IDTA); (d) Binding Corporate Rules where applicable.

Israel-Specific Transfers

Israel has been recognized as providing adequate data protection by the European Commission. Transfers from the EU/EEA to Israel are permitted without additional safeguards. For transfers to other countries, we implement appropriate protection measures.
